Moroccan Women’s Group Pushes for Equal Child Custody Rights in Divorce

In Morocco, calls for reform of the Family Code (Moudawana) continue. An association is campaigning for legal custody of children, which currently belongs by right to the father, to also be granted to women in case of divorce.
The association in question has launched a campaign to call for "equality in legal custody of children," urging the authorities to reform the Moudawana. In a press release published this week and relayed by Al Ahdath Al Maghribia, the association recalls that "the woman now plays an important role in public life, but access to her rights is still hampered by classical legislation that continues to exclude her."
Under Moroccan positive law, child custody automatically goes to the father in case of divorce. The feminist association is determined to fight what it considers an injustice against women. It advocates in particular for an amendment of Articles 230, 231, 236 and 237 of the Family Code so that child custody is also granted to the mother in case of divorce.
