Moroccan Notaries Protest Competition Council’s Fee Reform Proposal

The National Council of the Order of Notaries of Morocco condemns the opinion of the Competition Council on the fees of notaries, published in the Official Bulletin on February 13. In this regard, it is organizing a press conference tomorrow to denounce this reform.
Meeting urgently last Friday to discuss this opinion, the CNONM was outraged to see the Competition Council consider the fees of notaries as a "commodity subject to the law of supply and demand".
The CNONM, which rejects the fact of taking the decree setting the fees of the adouls as a criterion to set the fees of the notaries, also opposes the capping of the fees of the notaries as stipulated in the draft decree setting the fees of the notaries.
This favorable opinion, issued on this draft decree by the Competition Council, was the last straw. It has angered the professionals who believe that the capping of fees paves the way for unfair competition, and that it goes against Article 15 of Law 32.09 relating to the organization of the notary profession: "The notary has the right to receive fees whose amount and methods of collection are set by regulation".
Therefore, the CNONM calls on the Executive to adopt the wording as agreed with the Ministry of Justice and the other departments and contained in Law 3.09. It also refuses the wording "the notary receives [...] fees not exceeding the tariff in the annex [...]", contained in the draft decree.
To better express its anger, the CNONM has called for a general strike on February 27 and 28, which will be renewed until its demands are taken into consideration.
