Moroccan Man Convicted in Domestic Violence Case, Faces Additional Charges

A Moroccan national was sentenced to one year in prison for giving a "slap" to his wife during a "family dispute". He is also accused of rape and abuse, crimes for which the prosecution has requested twelve years in prison against him.
The Provincial Court of Seville, in a judgment dated July 24, sentenced the Moroccan, AES, accused of assault and battery on his wife, to pay a fine of 200 euros to the victim, with a ban on approaching her within 500 meters or communicating with her for two years.
The accused and his wife live with their two daughters in his parents’ home. The couple engaged in regular disputes and the woman was a victim of domestic violence, even rape.
The court indicated that it did not find any signs of violence on the young woman, while she claims that the man "threw her against the bed, undressed her and sexually assaulted her". Similarly, it was not proven that the husband did not respect the no-contact order issued by the court, or that he "had physically or verbally assaulted" the victim.
While the victim persists and signs that she was sexually assaulted, the accused retorts that the relations were "consensual", admitting that he "lost control and slapped her" on February 27. Regarding the usual mistreatment, the victim "did not provide concrete evidence" of her allegations.
Regarding the rape, the court believes that "without a doubt, the relationship was maintained in an unpleasant manner", but cannot be considered a crime.
