Moroccan Court Rules Highway Company Liable for Donkey Collision

A Moroccan driver has won a legal battle against the National Motorway Company of Morocco (ADM) following a rather unusual accident. While driving on the highway, he collided with a stray donkey, causing material damage to his vehicle.
The Administrative Court of Casablanca ruled in favor of the driver, finding that the ADM had failed in its safety obligations. The main argument? The lack of adequate fencing to prevent the intrusion of animals onto the highway, a shortcoming that led to this regrettable accident.
The ADM, which manages the toll highways, has the responsibility to ensure the safety of users, the court recalled. Faced with this argument, the company tried to defend itself by claiming that the accident was a fortuitous event and that the driver should have been more vigilant.
A technical assessment was ordered to assess the damage and determine the amount of compensation. The ADM’s insurer then asked to be excluded from the procedure, arguing the existence of a compensation ceiling for material accidents.
To no avail! The court ordered the ADM to compensate the driver, with its insurer having to foot the bill.
