Moroccan Court Orders School to Reinstate Student, Imposes Daily Fine

A school group was dragged to court for refusing to re-enroll a student whose intellectual level was said to be below that required by the school. The Court of First Instance in Rabat, after hearing the various parties, ordered the re-enrollment of the student, accompanied by a fine of 1500 dirhams for each day of delay taken by the school group before re-enrolling him.
On September 2nd, the Court of First Instance handed down a verdict that will undoubtedly make history. A student refused enrollment for the 2019-2020 school year has been reinstated in his rights.
He will therefore be able to enroll in the 6th year of primary school at the establishment at the heart of the dispute, according to the details provided by Barlamane.com. For the website, the establishment defended itself by claiming that the student did not have the cognitive abilities to adapt to the level of the courses.
But it also used as a defense the plaintiff’s average of 5.76/10, while the school group’s internal regulations stipulate that a student must obtain a semester average of 6.75/10 or more, to have the right to re-enroll the following year.
