Maroc Telecom’s $270 Million Fine Upheld by Rabat Court in Infrastructure Sharing Case

Maroc Telecom’s appeal against the liquidation of the penalty imposed by the National Telecommunications Regulatory Agency (ANRT) was rejected by the Rabat Court of Appeal.
The national operator had filed an appeal at the end of August before the courts against the regulator’s decision to order it to pay 2.7 billion dirhams. This sanction follows Maroc Telecom’s failure to comply with the injunctions issued in 2020 by the ANRT for the sharing of telecommunications infrastructure. Maroc Telecom was accused of abuse of dominant position, recalls Medias24.
On Wednesday, the hearing chaired by Judge Rachid Houbabi ruled in favor of the regulator’s decision, thus maintaining the financial penalty. The rejection of this appeal has no impact, as in a recent note on its financial results, the company announced the payment of this fine.
However, notes the same source, this verdict has a symbolic scope, as it is a first in Morocco. Never before has the justice system ruled on an appeal filed against the decision of a competition regulator.
