New Legal Path for Victims of Municipal Construction Site Accidents in Morocco

A mechanism is now in place to allow victims of accidents caused by potholes on roads or construction sites in municipalities to take legal action.
The victim would only need a medical certificate and a bailiff’s report to take legal action. The emergency services of hospitals are authorized to issue the medical certificate to the victims, which specifies the nature and cause of the accident, Assabah reports.
With this new mechanism, motorized or non-motorized citizens, victims of accidents due to potholes that puncture the roads of boulevards and sidewalks of cities, can now sue the responsible administration and the contractors in charge of the work.
Many motorists and pedestrians are often victims of unprotected construction sites in the country’s municipalities. On the ground, there is a lack of signage, which is often the cause of some accident cases.
Taking advantage of this opportunity, the president of an association has even filed a lawsuit against the president of the urban municipality of El Jadida, after being a victim of potholes on the road.
