German Court Upholds Muslim Student’s Right to Wear Burkini in School Swimming Lessons

According to the Administrative Court of the city of Halle, freedom of religion also translates into the freedom to dress according to one’s beliefs. By authorizing a Muslim minor to wear the Islamic veil, the court ruled that exemption from school lessons can only be done in exceptional cases.
Despite the measures imposed by the establishment, the Court specified that Article 4 of the Constitution guarantees every person the right to live according to their religious beliefs and to express them.
Instead of trying to impose restrictions on freedom of religion, both on the student and her parents, it would be salutary to find an intermediate solution, in order to ensure the child’s better school integration, adds the Court.
Referring to the Holy Quran, the Muslim minor had specified that her own religious beliefs did not allow her to unveil in front of strangers other than members of her family. The court ruled in her favor.
