France Residence Permit: Seasonal Worker Receives OQTF After Status Change Request

The Moroccan national held a multi-year “seasonal worker” residence permit, valid from July 2019 to July 2022. Before it expired, he had applied for a temporary permit bearing the “employee” designation, in order to change his status and work permanently in France.

The Hérault prefecture rejected his application. It also granted him thirty days to leave French territory and designated the country to which he could be sent back.

The seasonal permit is not enough

The trap lies in the specific nature of the seasonal residence permit. It allows its holder to work in France for a maximum of six months each year, but requires them to maintain their usual residence in Morocco and return there between work periods.

According to the courts, subsequently applying for an “employee” permit is therefore not simply a renewal or change of status. The procedure is treated as a first application for a residence permit and requires the presentation of a new long-stay visa corresponding to the intended stay.

The visa and permit bearing the “seasonal worker” designation are not sufficient, even when the worker has an employment contract. In the absence of the required visa, the prefecture may refuse the permit and accompany its decision with an OQTF.

The Council of State confirmed this interpretation on 12 March 2026. It dismissed the Moroccan worker’s appeal, noting that he had also failed to demonstrate either particularly strong family ties in France or humanitarian circumstances that could justify exceptional regularization.

To obtain an “employee” permit, a Moroccan seasonal worker must therefore normally return to Morocco and apply to the French consular authorities for the appropriate long-stay visa before submitting the application.
