Constitutional Court to Rule on Controversial Moroccan Lawmakers’ Pension Bill

The Authenticity and Modernity Party (PAM) wants the Constitutional Court to invalidate the bill passed in plenary session of the House of Councillors and related to the liquidation of the pensions of members of the lower house. It has this week filed a brief containing several motions, in order to reject this bill that comes to silence months of controversy.
The party led by Abdellatif Ouahdi believes that this text "has no basis in the Constitution", nor in the "organizational sphere". "What makes this law unconstitutional is not related to its form, but rather its substance," explained the PAM, stressing that the pension system for parliamentarians is not managed by an organic law of the Chamber, nor by a normal law or a decree. The PAM also notes the absence of the government during the discussions of this bill and considers that this "contravenes the provisions of the Constitution and the organic law relating to the House of Representatives".
In addition, the text "does not take into account the constitutional principles established in the organization of public funds and the role of the Court of Auditors in this matter," it added. However, the approach taken by the PAM did not receive the approval of everyone.
In this sense, Ibtissame Azzaoui, a former PAM MP, indicated on her Facebook page that the party’s approach remains "incomprehensible". "The bill was unanimously voted on in both chambers, and if there were controversial articles or content, the opposition should have been expressed during the committee meetings and the situation would have been settled by rejection or abstention," she lamented, stressing that she is "convinced" of the content of the proposal aimed at liquidating these pensions.
