Paris prefecture wanted to deport him: this Moroccan obtains his residence permit and 1,200 euros

The Moroccan national, born in 1986, states that he arrived in France on September 13, 2021. He initially applied for a residence permit on medical grounds in December 2023, before submitting, on June 17, 2025, an application for exceptional admission to residence.

The police prefecture had rejected his applications in two orders dated July 4 and 21, 2025. It had also ordered him to leave France within thirty days, designated his country of removal and imposed a two-year ban on returning.

In December 2025, the Paris Administrative Court had already annulled part of the removal measures, including the ban on returning. It had nevertheless upheld the refusals to issue a residence permit. The Moroccan then decided to appeal.

His job in the hotel industry changes the outcome of the case

The employment contracts and pay slips submitted to the court show that he has been working since November 25, 2022, as a reception employee in the hotel industry. However, this position is among the occupations facing recruitment difficulties in Île-de-France.

In its ruling of September 14, the Paris Administrative Court of Appeal also notes that the Moroccan has been living in France since 2021. His situation therefore met the criteria allowing the exceptional regularization of a foreign national who had worked in an occupation experiencing labor shortages for at least twelve months during the previous two years and could prove three years of residence.

In the judges’ view, the prefecture made a manifest error of assessment by refusing him residence. The court therefore annuls both refusals, as well as the OQTF and the decision designating the country to which he was to be sent. Another Moroccan cook threatened with deportation had already obtained a court order requiring the prefect to issue him his papers.

The decision does not leave the prefecture the option of simply conducting a further review. It orders it to issue the Moroccan, within two months, a residence permit bearing the designation “private and family life.” In the meantime, he must receive a temporary residence authorization allowing him to continue working.

The state must also pay him 1,200 euros for the costs incurred in the proceedings. The Moroccan initially requested 2,000 euros as well as a penalty of 50 euros per day of delay, but the court did not grant either of these requests.

After more than a year of proceedings and two appearances before the administrative courts, the man whom the prefecture wanted to remove therefore obtains not only the complete annulment of the decisions still being challenged, but also an order requiring the administration to hand over his papers.
