Morocco Simplifies Birth Registration Process with New Paternity Recognition Rules

A new circular from the Ministry of the Interior to the Walis and Governors of the Prefectures and Provinces in Morocco aims to support the declaration of birth by a document of recognition of paternity, in order to avoid citizens having to go to court.
The circular allows parents to register the child in the civil registry by simply producing the document of paternal recognition, provided that the declaration is made within the regulatory deadlines.
If the recognition takes place while the child is already registered in the civil registry, this mention will be added by virtue of a corrective judgment, regardless of the nature of the relationship between the spouses.
The Minister added that under Article 23 of the Civil Status Law, the father who recognizes the paternity of the child and is not married, cannot have the family record book. In addition, he can register him in his personal notebook and add the mentions of the mother on the child’s page.
Moreover, the pages of the civil status booklet, reserved for wives, only concern mothers who have a marriage certificate with the father. The mother of the recognized child, who does not have a legal link with the father, cannot obtain a copy of the civil status booklet and her name cannot be mentioned on her son’s page.
