Moroccan Man Sentenced to 10 Months for Violent Domestic Assault in France

A 30-year-old man of Moroccan origin was sentenced on Monday by the Bourges Criminal Court to ten months in prison for domestic violence against his wife.

The accused, whose identity has not been verified, was prosecuted in immediate appearance for violence against his wife and her friend. The woman told investigators that on April 19, her husband, under the influence of cocaine, violently assaulted her, dragging her to the ground, punching and headbutting her, tearing out her hair, strangling her and pushing her against a wall. She adds that she was taken to the Vierzon hospital by firefighters, alerted by a police patrol who found her injured on the ground at her home, rue des Épinettes in Vierzon, reports Le Berry.

During his appearance, the Moroccan, assisted by an interpreter, denied the facts. "I shouted, I had verbal exchanges, but I didn’t touch her," he claims. But his wife, her friend and a witness say otherwise in their statements. Moreover, the medical certificate issued to his wife by the emergency physician and the five days of total incapacity for work (ITT) prescribed to her prove that she suffered violence. The defendant’s wife states that her husband is "jealous and possessive" and spends his time rummaging through his wife’s phone.

It’s not true, rejects the accused, who mentions the existence of a relationship between his wife and another man. But no evidence corroborates this allegation. In her statement, the woman said she is separated from the accused. But in the dock, the Moroccan seemed to deny this, stating that he is still in a relationship with the victim. The deputy prosecutor requested against him a sentence of fifteen months in prison, as well as a ban on approaching the victim, her home, going to Vierzon and a permanent ban from French territory (ITF).

"He did not commit any violence, which is not corroborated, nor is he separated either," argued the defense lawyer, Me Sandra Leblanc, who requests the acquittal of her client. Finally, the court sentenced the accused to a term of ten months in prison for violence against his wife. He has ten days to appeal.
