He Refuses to Return to Morocco, and the Court Refuses to Release Him

The man concerned believed that the proceedings had lasted too long: the Netherlands had been waiting for nearly three months for a Moroccan laissez-passer. But in a decision issued on 17 August by the Hague court, the judge noted that the Dutch authorities had contacted Morocco again on 4 June, 26 June and 16 July.

“I Don’t Want to Return to Morocco”

During an interview on 25 June, the man stated that he did not want to return to Morocco and that he would take no steps to facilitate his departure. For the court, this refusal to cooperate matters: it cannot be ruled out that the procedure would move forward more quickly if he participated in it himself.

The laissez-passer has still not been issued, but the Moroccan authorities have not indicated that they would refuse it either. The judge therefore considers that expulsion to Morocco remains possible within a reasonable period.

No flight can yet be booked as long as the man’s identity and nationality have not been definitively established. His appeal was ultimately rejected: he remains in detention while the Netherlands continues its efforts with Morocco.
