French Court Rejects Repatriation Pleas for ISIS Wives and Children in Syria

The position of the Council of State is likely to disappoint many French women and their children currently stranded in Syria. Indeed, the jurisdiction has rejected the requests, stating that "the repatriation measures requested do not fall within the competence of a judge but of diplomacy".
Le Monde, AFP, Reuters and MAP have reported the information, stating that this rejection by the Council of State comes after that of the "Paris administrative court which had invoked the fact that it was not competent in the matter".
"The measures thus requested for repatriation, which cannot be made possible by the mere issuance of a document allowing them to cross French borders, as requested at the hearing, would require the undertaking of negotiations with foreign authorities or an intervention on foreign territory," a ruling by the Council of State has indeed clarified.
As a result, with the repatriation plan at a standstill, "The families are facing a denial of justice, although the situation is only getting worse," regretted Me Nabil Boudi, lawyer for the uncle of two minors, who also believes "that today, everything is locked, whether with the Quai d’Orsay or on the side of justice".
Le Monde reports that among the people to be repatriated, "three of them came from French women linked to the Islamic State (IS) organization and held in a camp in Syria with their eight children. One last came from the uncle of two minors, aged two and four, who has been demanding that the state repatriate them from another Syrian camp, under the control of the Kurdish forces, where they live".
