The 40-year-old Moroccan woman was subject to an OQTF when she reported to the Vesoul police station on August 9 as part of her house arrest. Her simple check-in ended with her being placed in the Metz detention center.

A few days later, the liberties and detention judge invalidated her detention. Nisrine had been reunited with her six children, but a new expulsion to Morocco was immediately scheduled.

The prefect ultimately suspends the expulsion

According to L’Est Républicain, the prefect of Haute-Saône decided to postpone enforcement of the removal order until the Nancy Administrative Court of Appeal rules on the substance of the case.

This decision comes after several days of mobilization. Around 130 people had gathered outside the prefecture, and a petition had surpassed 1,700 signatures. Her lawyer, Me Florent Diaz, believes that his client has now been granted several months of respite.

The OQTF has not, however, been annulled. If the court rules in Nisrine’s favor, the prefecture will have to review her situation. If her appeal is rejected, the removal order may once again be enforced.

The prefecture, for its part, suggests that this period be used to consider a voluntary return to Morocco. Since the OQTF does not include any ban on returning to France, Nisrine could then apply for a visa from the French consular authorities in Morocco.
