Belgium: green light for extradition to Morocco of a suspect wanted in Nador

Belgium dispels fears concerning allegations of torture and ill-treatment and decides to extradite a man wanted in Nador to Morocco. This suspect faces a heavy prison sentence or life imprisonment.

B.O., already extradited to Morocco? The Belgian Minister of Justice, Annelies Verlinden, signed the order for his extradition at the end of June 2025. The Moroccan justice system had sent an extradition request to Belgium for this man wanted in Nador for "the crime of joining an association and an agreement to organize and facilitate the exit of individuals from the national territory in a clandestine and habitual manner, resulting in a death". This man had been arrested by the Belgian police in Brussels last year. But his lawyers fear that their client will be subjected to torture and inhuman and degrading treatment.

Julien Hardy and Marie Hennico then asked the Council of State to suspend this order, but they were met with the judges’ refusal, as reported by La Dernière Heure. "The Moroccan judicial authorities, represented by the Nador Court of Appeal, have undertaken not to harm the physical or moral integrity of the person to be extradited and not to subject him to cruel, inhuman, degrading or human dignity-violating treatment, whether during the investigation, the trial or in the event of his conviction, and to provide him with a fair trial," they argued.

The Belgian Council of State explains that B. O.’s lawyers did not provide any concrete elements "likely to lend credence to their fears." It also considers "not serious" their argument that their client risks life imprisonment. Belgium therefore sees no obstacle to the extradition of the suspect.
