Belgium: Cell Phone Use Under Headscarf While Driving Deemed Legal, Experts Warn of Risks

It is not uncommon to see women talking on their cell phones under their headscarf on the roads. This practice is a priori legal in Belgium, as explained by an expert to the Belgian newspaper La Dernière Heure.
Thus, according to Benoît Godart, spokesperson for the Vias institute (formerly the Belgian Institute for Road Safety), interviewed by the newspaper, the Belgian highway code mentions the prohibition for the driver to use the phone held in the hand. If the cell phone is not held in the hand, it is therefore perfectly possible and therefore legal to make a call.
However, even if it is legal, it is not recommended. "The phone is likely to slip and fall, so it’s not ideal. In general, we also recommend not to use the phone while driving, even with a hands-free kit."
Therefore, the woman talking on her cell phone under her headscarf is not acting illegally, even if it is not recommended.
