Arriving in France in 1962, this Moroccan man receives an OQTF at 74

Born on 31 December 1951 in Ijermaouas, Morocco, the Moroccan national says he arrived in France in 1962. He held a “private and family life” residence permit, for which he had requested renewal on 12 August 2025.

On 29 April 2026, the police prefecture rejected his application. It also ordered him to leave France within thirty days and designated the country to which he could be removed.

The Moroccan man then took the matter to court. He notably explained that losing his residence permit threatened his access to healthcare and health insurance coverage, as well as his pension rights and entitlement to the solidarity allowance for elderly people.

The judge takes his age and ties to France into account

In its order of 27 July 2026, the Paris Administrative Court identified several elements in his favor: the stability and strength of his ties with a French national, his vulnerability and the significant overall length of his presence in France.

For the judge, these factors raise serious doubts about the legality of the refusal to renew his residence permit.

The court therefore suspends this decision pending a ruling on the merits. The police prefecture must review his situation within three months and issue him, within fifteen days, a temporary residence permit.

However, the court does not annul the OQTF in these emergency proceedings. Its enforcement remains subject to the separate action on the merits brought against the order of 29 April 2026.

The case has therefore not been definitively decided. Nevertheless, the state must pay the Moroccan man 1,000 euros for his legal costs.
